By Placing an Order, You Agree to These Policies

All sales with By The Roadside are final. By completing a purchase, you acknowledge and agree to the policies outlined below, which ensure transparency and clarity for all customers. Please read carefully before placing an order.

Property & Delivery Liability

By placing an order with By The Roadside, the customer acknowledges and agrees that we are not responsible for any damages incurred to driveways, property, landscaping, or vehicles once the delivery driver leaves the state-maintained road. The customer assumes full responsibility for any potential damage and agrees to pay for all wrecker fees or property repairs if the delivery vehicle becomes stuck or causes damage.

Mulch Stone & Gravel Policies

All mulch stone and gravel sales are final. Due to the nature of these products, they cannot be returned or refunded once delivered.

Mulch Customers

  • Colored Mulch Drying Time: Our designer-colored mulches (e.g., Jet Black, Brown, Auburn, Bright Red, Cherry Pine) require 24-48 hours of drying time without rain, irrigation, or moisture to prevent color bleeding.

  • By placing an order, the customer understands that premature exposure to water may alter the mulch’s appearance, and we are not responsible for fading, runoff, or staining due to weather conditions.

Gravel Customers

  • Customer Preparation: Customers must ensure that the delivery area is accessible and properly prepared before the gravel arrives. This includes clearing obstacles and providing clear instructions for placement.

  • No Spreading Guarantee: By The Roadside does not offer spreading services for gravel.

  • Our drivers may attempt to spread gravel as a courtesy, but we do not guarantee the service or the quality of the spreading.

  • Liability Release: If a driver spreads gravel at the customer's request, By The Roadside is not responsible for any damage, uneven distribution, or gravel piles left on the property.

Non-Returnable and Non-Refundable Policy

Mulch and Gravel

Due to the nature of these materials, all mulch stone and gravel purchases are non-refundable, non-returnable, and non-exchangeable. Once an order is placed and delivered, it cannot be canceled or refunded for any reason, including dissatisfaction with natural variations in the product or improper storage by the customer.

Firewood and Flowers

Due to the nature of these items, all firewood and flower purchases are non-refundable, non-returnable, and non-exchangeable. Once an order is placed, it cannot be canceled or refunded for any reason, including weather conditions, changes in personal plans, or dissatisfaction with natural variations in the products.

Apparel

All apparel is non-refundable and cannot be returned or exchanged. Please check sizes carefully before placing your order. If there is a defect or issue with the order, please contact us within 48 hours of delivery for assistance.

Digital Products

All digital products are sent directly to the customer’s email upon purchase. Due to the nature of digital content, these items are non-refundable and non-returnable.

Apparel Shipping

Apparel orders are shipped via mail with an estimated delivery time of 7-21 business days. Once shipped, tracking information will be provided to help monitor your order. All apparel is made to order.

Pickup and Delivery

Firewood

  • Firewood orders cannot be scheduled for pickup.

  • For delivery, please provide instructions in the Notes section on where to stack and if you prefer a call before arrival or have any specific drop-off instructions.

Bouquets

  • Bouquet orders can be scheduled for pickup or delivery.

  • Please include any preferences, such as vase or no vase, color choice, or specific drop-off instructions in the Notes section.

Delivery Fees

  • Delivery fees vary based on your zip code.

  • Where to stack or deliver items

  • Contact preferences (e.g., calling ahead before arrival)

  • Special delivery notes for flowers (vase preference, color choice)

  • Preferred drop-off location for mulch, gravel, or stone to avoid misunderstandings

 

U-Pick Experience Expectations

For those participating in our U-Pick experience, please:

  • Wear appropriate footwear and sun protection.

  • Bring any necessary tools (e.g., clippers for cutting flowers, bucket of water).

  • Supervise children at all times.

  • Be respectful of the plants and avoid over-picking to ensure others can enjoy the experience as well.

Nature’s Creatures in the Garden

Our garden is a delightful haven for butterflies, bees, and other little pollinators that love our flowers as much as you do! While you enjoy the blooms and beauty, please be aware that our buzzing friends are busy here, too.

We kindly remind all visitors to be prepared for encounters with bees, butterflies, and other insects. They add to the magic of the garden, but please take care if you have sensitivities or are allergic to bees or other critters. By visiting, you acknowledge that nature may get up close and personal—and we, the caretakers, are not responsible or liable for any encounters.
